PRASPECT TECHNOLOGY COMPANY LIMITED (“Company”, “we”, or “us”), cares about the privacy of our customers, thus, we publish this Privacy Policy (“Policy”) to inform our customers of our Policy in relation to the collection, use and disclosure of personal data of individual (“You”) in accordance with the relevant laws and regulations. Only with your express permission will our Company collect and use your personal data to the extent of your consent.


FALCON SCM CO., LTDบริษัท ฟอลคอน เอสซีเอ็ม จำกัด, a qualified loan provider duly established and licensed in Thailand (“Lender”), has granted PRASPECT TECHNOLOGY COMPANY LIMITED (“Developer”) to distribute loan through this loan application สินเชื่อKM (“App”). Both Lender and Developer (“Company, “we” or “us”), cares about the privacy of our customers, thus, we publish this Privacy Policy (“Policy”) to inform our customers of our Policy in relation to the collection, use and disclosure of personal data of individual (“You”) in accordance with the relevant laws and regulations. Only with your express permission will our Company collect and use your personal data to the extent of your consent.



1. Collection of your personal data

When you use the App, you give us your personal data directly through your interaction with the App so that we can provide a decent loan service to you. Personal information we collect through your active provision may include: (1)full name, (2)date of birth, (3)gender, (4)residential address, (5)telephone number, (6)emergency contacts, (7)ID information, (8) beneficiary's bank account information, (9) biometric information.

We may also collect information from your device automatically backstage. The information and permissions we collect includes:

(1) Location,when you interact with this application, we will collect your geographic location data in the foreground. When this application is in the background, we will stop collecting your geographic location information. You can always choose to temporarily disable geographic location tracking information on your mobile device.

(2) SMS, we only monitor financial SMS (4-digit financial SMS), including the sender, description and date sent in the user's inbox, which helps us identify the various accounts held by the user and the cash flow patterns owned by the user to help us determine the user's risk profile and provide appropriate credit analysis for the user. In addition, we collect and process telephone data, such as SMS logs. for risk analysis, to assess a user's eligibility to use our products or services (including, but not limited to, by assessing the user's creditworthiness, determining whether the user can afford the products or services requested by the user and/or determining whether the user is eligible for additional benefits of available products); to provide loan services to users (including, but not limited to, by processing your transactions and processing the user's loan payments and collecting the user's loan repayments); verifying the identity of users and/or other information provided to us by users; detecting, combating and preventing fraud, attempted fraud, money laundering and/or other illegal use of our services; analyzing customer behavior; interfacing with credit reference or fraud prevention agencies; and providing customer service or support. To contact you using text (SMS) messages (if applicable) in accordance with the purposes described in this Privacy Policy.

(6) contacts, in order to streamline the loan application process, the users may choose to select emergency contacts from their phone's contact list. This means that we will collect contact information from users, which will be used to automatically fill in the application form. We may also analyze this information for risk assessment purposes, such as determining a user's creditworthiness or eligibility for certain products or services. Additionally, we may use the contact information to verify users' identities, prevent fraud and other illegal activities, and analyze customer behavior. Please note that we may contact you via phone for these purposes, using an autodial or prerecorded message call.

(7) call log, for the purposes of identity verification and prevention of identity theft and loan fraud, we may collect your recent call log when you register or log in to our app via voice verification. This allows us to verify that the mobile phone card in your device matches the registered phone number used to receive verification codes. To identify potential fraud risks, this data may be uploaded to our servers for risk identification purposes. Please be assured that your data is only used for this purpose and will be deleted after use. We take data privacy seriously and will never share your information with third parties.

(8) other phone information, we will collect device information to help us identify your user profile and recommend suitable products, which includes device brand, model, operating system version, device network environment, WiFi, device status, application software information, device memory information.


2. Use/purpose of your data

Personal Data shall be processed, collected, used, disclosed, stored, and retained for the following purposes:

• to identify Users;

• to contact Users in relation to their registered account/s or requested information;

• to process registration of account/s and to determine or assist in determination of decisions as part of screening of the investors, borrowers, registrations or loan applications, and/or to deliver our products and/or services to the User and any directly related purposes;

• to facilitate loan processing from application, review, monitoring, payment, collection and other remedial measures;

• to maintain internal records;

• to market and offering new, related or complementary products and services to the User;

• to conduct background check and identity verification;

• to conduct and perform fraud monitoring, detection, analysis and prevention;

• to prevent, detect and investigate actual or suspected crime and analysing and managing commercial risks;

• to conduct data analytics and tracking;

• to conduct market research to enable the App to understand and determine customer location, preferences and demographics to develop special offers, products or marketing programs in relation to products and services, and to improve (i.e. customized offers and products) such products and services;

•  to perform research on data to conduct investigations relating to disputes, payment, suspected illegal activities or fraud;

•  to carry out marketing and promotions initiatives relating to our company, local affiliates of the company, the company’s partners, and other company’s products and services, whether by electronic means, by email and post, or by telephone, SMS or social media, or by sending newsletters (for example, for the Users to be updated on new products or features and to publicize events, contests, demonstrations, loyalty programes, and other activities organized by the company and/or the company), also by using automated means. Such communications will relate to products and services of the financial products, services and the like.

•  to develop, enhance and maintain a risk assessment process and model, offline and online;

•  to develop and generate a credit score, credit model and user model;

•  to enroll/participate the user in group credit and/or life insurance, credit risk analysis, credit investigation, credit scoring and credit collection on the User;

•  to perform User location search;

•  to execute, monitor, manage and  analyse the App and to develop, enhance, and upgrade the features, functions, products and services in the App, including promotions, loyalty and reward programs;

•  to respond to User queries and requests;

•  to facilitate business asset transactions (which may extend to any mergers, acquisitions or asset sales) of the company;

•  to facilitate and as may be required as part of any financing or capital raising activity (i.e. obtaining loans, credit facility, mortgage, assignment, assignment as a form of security or mortgage of loans);

•  to initiate and maintain correspondence with the User via electronic mail (e-mail), SMS (short messaging service), in-app message/communication, registered mail, phone calls or field visits;

•  to resolve complaints and handling requests and inquiries;

•  to monitor or record phone calls and customer-facing interactions for quality assurance, employee training and performance evaluation and identity verification purposes;

•  to provide information to external parties such as government agencies, and other institutions as part of scientific research and/or study; and

•  for any other legal and/or regulatory purposes (including but not limited to obtaining legal advice and dispute resolution) and legitimate business purposes and to carry out all mandatory administrative, operational and legal duties


3. Sharing of your Personal Data.

We will take utmost care to ensure that your personal data is not shared without your permission. We may share your personal data to the extent allowed by applicable laws to the following subjective:

(1) authorized employees of our company and its affiliates, including our company’s auditor or external auditors, financial cooperative institutions, and/or third parties that are related to our company;

(2) the Credit Bureau (a type of credit reporting agency);

(3) the governmental authorities conducting legal investigation or legal actions;

(4) the third-party cooperative institutions, including fund lenders, payment partners, post-loan partners, third-party verification service providers, messages service providers, call-out service partners;

(5) sharing with other subjects in accordance with laws, government orders, or regulatory requirements.


4. Biometric Information

(1) To ensure accurate identification and prevent loan fraud, we may ask you to provide a live face photo during the facial recognition process. Your facial data will be collected and processed only for the following purposes: verifying your identity, proving that the loan application was initiated by you, and preventing fraudulent loan activity. This information may be referenced at any time, including in the event of a dispute or investigation related to the loan.

(2) Upon completion of the facial recognition process, your face photo data will be uploaded to our server api.falconscmco.com and retained until the loan and any remaining payments are fully repaid. Additionally, we may be required to retain this information for an extended time period in order to comply with applicable laws and regulations, including statutory limitations. If you wish for your face photo data to be deleted immediately, please contact us by sending an email to KachingMoney@praspecttechnology.com

(3) We place great importance on protecting your privacy and will not disclose your face photo data to third parties unless we are required to do so by applicable law or as evidence in a dispute related to your loan. This may include presenting data to a court or arbitral tribunal, pursuant to a court order or under the authority of any government office or agency authorized by applicable law. If necessary, the relevant court, tribunal, or authority may retain your data for the duration specified by law.


5. Protection of your information

To ensure the safety of data transmission, we encrypt the information mentioned above and transfer it to our server located at api.falconscmco.com through the application. We will retain your data for the period specified by law and only for the purpose for which it was collected and utilized. If you require immediate deletion of your data, you may contact our customer service center by sending an email KachingMoney@praspecttechnology.com


6.Your user obligations

You agree to inform us promptly, and in any event, within 14 calendar days, in writing if there are any changes to your information provided to us from time to time, and to respond promptly to any request from us. 

Where:

(1) you fail to provide promptly any user information or Personal Data that we reasonably requested;

(2) you withhold or withdraw any consents that we may need to process, transfer or disclose Personal Data for the purposes of used disclosed above in this Privacy Policy (except for purposes connected with marketing or promoting products and services to you); and/or

(3) we have, or a member of our company has, suspicions regarding financial crime or an associated risk.

We may:

(1) be unable to provide new, or continue to provide all or part of the services to you and reserve the right to terminate our relationship with you;

(2) take actions necessary for us or a member of the company to meet the compliance or regulatory obligations; and/or

(3)suspend, transfer or close your account(s) where permitted under local laws.


7. Validity and accuracy of information submitted

(1) Submission of True and Accurate Information – You must submit to us information including Personal Data which is true and accurate and not misleading, and you must keep it up to date and inform us of changes as soon as practicable. We reserve the right to request for documentation to verify information provided by you.

(2) Voluntary Submission of Personal Data – We will only be able to collect your Personal Data if you voluntarily submit the information to us. If you choose not to submit your Personal Data to us or subsequently withdraw your consent to our use of your Personal Data, we may not be able to provide you with some or all of the services available through the App.


8. Your data rights

You can exercise your rights under the applicable laws, the details are as follows:

(1) Right to access your personal data;

(2) the right to withdraw your consent that has been given to us at any time pursuant to the methods and means prescribed by you;

(3) the right to rectify your inaccurate personal data and to update your incomplete personal data.

The exercise of the aforementioned rights must be carried out in writing by email to the following email address:KachingMoney@praspecttechnology.com After the application has been submitted in the aforementioned terms, we will issue the adopted determination.


9. Modification

We may change or update this privacy policy from time to time and we will inform you of the updated version as soon as possible. You can view the latest version of this privacy policy on the App.
